Analysis of Timberland Owned by San Jose Water Company

This detailed analysis has determined that San Jose Water Company owns more than 2500 acres of "Timberland" even by the most conservative definition of that term. In order to apply for a Nonindustrial Timber Management Plan (NTMP), San Jose Water Company must qualify as a "nonindustrial tree farmer". The California Forest Practice Act defines a "nonindustrial tree farmer" as "an owner of timberland with less than 2500 acres" (among other stipulations.) Therefore, San Jose Water Company is not legally qualified to apply for an NTMP. Disclaimer:   This information was offically submitted to CDF on 4/27/07. Any changes made to this analysis will be included in the official file as an addendum.

Update 9/28/07: CAL FIRE has denied San Jose Water Company's application for an NTMP on the basis of the argument presented in this report. SJ Mercury News Article here.
